As A Homeowner: In the state of Louisiana you are allowed to pull your own building permit provided the home under construction will be your primary residence. Should you build your own custom home with plans of selling it at a later date you can purchase a home warranty insurance policy that will cover structural issues that may occur. LICENSING Louisiana Law # R.S. 37:2150-2190 has an exemption form (CBR-14) which allows any homeowner to build his own home one time per year provided you occupy the home upon completion. This exemption was written specifi cally for individuals that do not hold a general contractors license but desire to build their own home. OSHA “OSHA’s only concern is with companies or corporations that have employees; therefore, as a single homeowner with no employees, you are NOT subject to the jurisdiction of OSHA consultation. If the homeowner decides to hire contractors that have employees, that contractor does fall under the OSHA guidelines and is responsible for the safety and health of their employees.” Greg Cook - Baton Rouge, LA OSHA WORKPLACE SAFETY CONSULTANT LIEN LAWS Most liens placed on properties under construction are due to the contractor not paying suppliers or laborers. Using the “Owner/Builder Program” you, as the homeowner, control your construction account and pay for all suppliers and laborers yourself which eliminates this unfortunate situation from happening with your custom home. FRIENDLY REMINDER The “Owner/Builder Program” does not recommend using a subcontractor that cannot provide proof of insurance for the work in which that company is being contracted to do. PERMITS The “Owner/Builder Program” has always recommended individuals building their own home pull permits and have independent inspections throughout the construction process even when not required by some parishes. Effective January 2007 all parishes in Louisiana now require these permits and inspections whether building inside or outside the city limits. WETLAND PERMIT 404 “When purchasing a lot from a developer, a wetlands determination should already have been made by the developer and/or his engineer. Be sure to ask for this determination prior to purchasing your lot. In cases where the lot has been determined to be a wetland, a Corps permit will be required.
